Important Notice Regarding AI-Powered Grading

MarkingEase relies on advanced Large Language Models to evaluate descriptive answers and generate assessments. This capability is designed to support educators as a feedback tool, not to replace professional grading. Teachers and administrators must verify all critical evaluations and official scores before making high-stakes academic decisions.

Welcome to MarkingEase! These Terms of Service ("Terms") govern your access to and use of the website, applications, and browser tools provided by MarkingEase ("we", "us", or "our"). Please read these Terms carefully before using our platform. By registering an account or using MarkingEase, you agree to be bound by these Terms and our Privacy Policy.

1. Account Policies & Registration

To utilize the quiz creation, live room host, and smart grading tools, you must register for an account. By creating an account, you agree to:

  • Provide accurate, current, and complete registration information, maintaining the integrity of credentials linked through Google OAuth or password logins.
  • Maintain the confidentiality of your account credentials and immediately notify us of any unauthorized activity.
  • Refrain from creating multiple accounts to circumvent subscription quotas or free trial thresholds.
  • Confirm you meet the minimum age requirement. If you are under the age of 16, your school or institutional administrator must provide prior parental consent before you can use the interactive student portions of the platform.

2. User Responsibilities & Conduct

As a user of MarkingEase, you are responsible for all data, content, and materials that you upload, transmit, or grade. You agree not to use MarkingEase to:

  • Upload, process, or disseminate copyrighted educational materials without the explicit permission of the copyright owner.
  • Deploy automated scrapers, scripts, or bots to harvest quiz content, questions, or evaluation keys.
  • Bypass or attempt to bypass security measures, including active cheat prevention systems, focus logs, and time-tracking features.
  • Upload prompts or inputs designed to trigger malicious outputs, inject prompt exploits, or hijack our Large Language Model configurations.

We reserve the right, but hold no obligation, to review, flag, or remove content that violates these Terms or our community guidelines.

3. AI Limitations & Verification Disclaimer

MarkingEase utilizes advanced generative AI systems for text extraction, question generation, and rubric-based score evaluations. You acknowledge and agree that:

"AI-generated content, feedback, and grading suggestions are tools intended to augment, not replace, human instruction. Large Language Models can occasionally hallucinate information, miss nuances, or return incorrect score recommendations."

  • Teacher Responsibility: Educators retain full academic and professional responsibility for all grades, feedback, and test structures published using MarkingEase. Teachers must check and verify critical results, especially where evaluations impact final grade point averages, graduations, or student status.
  • No Educational Guarantee: We do not guarantee that AI-generated questions align perfectly with specific national curriculums or school standards, nor that AI grades match standard human grading curves.

4. Limitation of Liability & Warranties

TO THE MAXIMUM EXTENT PERMITTED BY APPLICABLE LAW, MARKINGEASE IS PROVIDED ON AN "AS IS" AND "AS AVAILABLE" BASIS. WE EXPRESSLY DISCLAIM ALL WARRANTIES OF ANY KIND, WHETHER EXPRESS OR IMPLIED, INCLUDING BUT NOT LIMITED TO FITNESS FOR A PARTICULAR PURPOSE, MERCHANTABILITY, AND NON-INFRINGEMENT.

IN NO EVENT SHALL MARKINGEASE, ITS DIRECTORS, EMPLOYEES, OR PARTNERS BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, INCLUDING WITHOUT LIMITATION:

  • Loss of profits, student grade records, data, goodwill, or other intangible academic losses resulting from your access to or inability to use the platform.
  • Any grading inaccuracies, grading errors, or system recommendations resulting from our AI evaluation endpoints.
  • Unauthorized access, alteration, or interception of your user content by malicious third parties.

5. Subscription & Payment Terms

Certain features on MarkingEase are offered as paid subscriptions (such as Pro or Enterprise plans). Subscription payments are billed on a recurring monthly or annual basis. You may cancel your subscription at any time through your dashboard billing portal. Cancellations apply to the next billing cycle, and we do not issue refunds for partial subscription terms or unused credits.

6. Term, Termination, and Modifications

We reserve the right, without liability, to suspend, terminate, or restrict your account if you violate these Terms, breach academic integrity guidelines, or engage in behavior harmful to other users or MarkingEase's infrastructure.

We may revise these Terms from time to time. The most current version will always be posted on this page. If a modification is material, we will provide a notice prior to the changes taking effect. Continued use of the platform after updates implies acceptance of the new Terms.
